Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Smart Kids cognitive training service ("Service") provided by Advanced Learning Academy LLC ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

The Service is intended for use by children under parental supervision. The account must be created and managed by a parent or legal guardian.

2. Eligibility

To use the Service you must be at least 18 years old and the parent or legal guardian of each child whose profile you create. By creating an account you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. Subscription and Pricing

• Base plan: $24.95 per month for one child.
• Additional children: $12.48 per month for each additional child added to the account.
• Subscriptions are billed monthly to the payment method on file, processed by Stripe.
• You may cancel at any time through your Account settings or by contacting us. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.
• We reserve the right to change pricing with at least 30 days' written notice to your registered email address. Continued use after the effective date of a price change constitutes acceptance.

4. Free Trial Lessons

We may offer free trial lessons to prospective users. Free trial access is limited to one per household. We reserve the right to terminate trial access at any time.

5. Content and Intellectual Property

All lesson content, questions, explanations, assessments, graphics, and other materials available through the Service ("Content") are the property of Advanced Learning Academy LLC and its licensors, including content authored by Timothy E. Parker, Guinness World Records Puzzle Master. Content is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for your child's personal, non-commercial educational purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content without our express written permission.

6. Acceptable Use

You agree not to:

• Share your account credentials with others or allow unauthorized access to the Service.
• Use the Service for any commercial purpose or on behalf of any third party.
• Attempt to reverse-engineer, scrape, copy, or systematically download lesson content.
• Circumvent or interfere with any security or access control feature of the Service.
• Use the Service in any way that violates applicable federal, state, or local law.
• Misrepresent your relationship to any child whose profile you create.

We reserve the right to suspend or terminate any account that violates these Terms without notice and without refund.

7. Privacy and Children's Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with the Children's Online Privacy Protection Act (COPPA). Parents retain full rights to review, correct, and delete their child's information at any time.

8. Account Termination

You may delete your account at any time by contacting us at team@advancedlearning.academy. Upon account deletion, access to the Service terminates immediately, and we will delete your and your children's data within 30 days in accordance with our Privacy Policy. We reserve the right to terminate accounts for violation of these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Smart Kids brain-training exercises are educational tools. We make no guarantee or warranty that use of the Service will improve any specific cognitive outcome, academic performance, or test score.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ADVANCED LEARNING ACADEMY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Advanced Learning Academy LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law principles. Any dispute arising from or relating to the Service or these Terms shall be resolved exclusively in the state or federal courts located in Hamilton County, Indiana. You consent to the personal jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page with an updated effective date. For material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
